Legal Documentation

Documents that hold up before the regulator.

Agreements for sale, title reports and development agreements for MahaRERA projects, through our legal associates.

Who it applies to

Promoters registering or selling in a MahaRERA project, landowners entering development agreements, and lenders or investors needing legal due diligence.

ProvisionWhat it requires
Section 4(2)(g)Proforma allotment letter, agreement for sale and conveyance deed filed with the registration application
Section 13No more than 10% of the cost as advance or application fee before a registered agreement for sale
MahaRERA Format ALegal Title Report in the standard format, authenticated by a practising advocate

Legal opinions, title reports and drafting are delivered by practising advocates in their own name.

Documents required

Title chain and search report (30 years where available), 7/12 extracts or property cards, mutation entries, development or joint development agreement, powers of attorney, sanctioned plans and approvals, encumbrance and loan documents, and the promoter's draft sale documents.

Timeline

Timelines depend on the land records available and, for development agreements, on negotiation between the parties. We agree a timeline with you at the start of each assignment.

Consequences of non-compliance

An agreement that departs from the model form without disclosure invites complaints and can be read against the promoter.

Taking more than 10% without a registered agreement contravenes Section 13, attracting penalty under Section 61.

Title defects found after registration can lead to suspension of sales and refund claims.
