Who it applies to
Developers raising construction finance, project loans, inventory funding or lease rental discounting, and landowners or JDA partners funding their share.
Where RERA meets finance
| Provision | Why lenders care |
|---|---|
| Section 4(2)(l)(D) | Loan drawdowns and allottee receipts must fit the 70% account and withdrawal rules |
| Section 11(4)(h) | No mortgage or charge on an apartment after an agreement for sale; any charge does not affect the allottee's rights |
| QPR disclosures | Encumbrances and loans appear on the public project page each quarter |
| MahaRERA Order No. 56/2024 | Account structure and change-of-bank approval affect escrow and lender arrangements |
Documents required
Three years' financial statements of the promoter, project report and approvals, RERA registration and QPR history, Forms 3 and 5, title and Legal Title Report, sales MIS and receivables, cost estimates and contractor agreements, and existing loan details.
Timeline
Lender appraisal and sanction depend on the lender and the quality of the file. We cannot promise a sanction, a rate or a timeline; the lending decision is always the lender's.
Consequences of getting it wrong
Drawdowns that do not reconcile with Form 3 delay disbursement.
Charges created on sold units breach Section 11(4)(h) and expose the promoter and lender to allottee claims.
Undisclosed encumbrances in QPRs invite MahaRERA scrutiny.
