Who it applies to
Individuals and investors buying in MahaRERA projects, and allottees facing delay, defects, or refund disputes.
Your rights
| Provision | Right |
|---|---|
| Section 19 | Allottee's right to project information, stage-wise schedule, possession and documents |
| Section 18 | Refund with interest on withdrawal, or monthly interest for delay if the allottee stays |
| Rule 18, Maharashtra RERA Rules 2017 | Interest at SBI highest MCLR + 2% p.a. |
| Section 14(3) | Structural defects rectified by the promoter within 30 days if notified within five years of possession |
| Section 31 | Complaint to MahaRERA; compensation claims before the Adjudicating Officer under Section 71 |
Documents required
For a pre-purchase check: project name or MahaRERA number and the draft agreement.
For a complaint: agreement, allotment letter, payment receipts, correspondence, and possession or OC documents if any.
Timeline
Pre-purchase checks and agreement reviews are scoped when you contact us. Complaint timelines depend on MahaRERA's cause list.
What happens if buyers do nothing
Section 18 relief is recovered only when the allottee claims it; delay weakens evidence and the negotiating position.
Defects not notified within five years of possession fall outside Section 14(3).
How we help
- Pre-purchase check: registration validity, QPR history, approvals, encumbrances, complaints and Form 3 trends
- Review of the agreement for sale against the model form
- Complaints for delayed possession, refund, interest and defects
We run a conflict check before accepting any matter and do not act against an existing client.
