FAQs
Frequently asked questions
What is RERA and who administers it in Maharashtra?
The Real Estate (Regulation and Development) Act, 2016 regulates the real estate sector to protect homebuyers and bring transparency. In Maharashtra it is administered by the Maharashtra Real Estate Regulatory Authority (MahaRERA).
Which projects must be registered?
Any project on land above 500 sq. m. or with more than eight apartments, including all phases, must be registered before it is advertised, marketed, booked or sold. Projects that were ongoing on 01-05-2017 without a completion certificate also had to register.
How long does MahaRERA registration take?
Under Section 5, MahaRERA must grant or reject a complete application within 30 days. Most delays come from document gaps and queries, which our pre-filing review is designed to prevent.
Why does MahaRERA need three bank accounts?
For projects registered on or after 01-07-2024 (MahaRERA Order No. 56/2024), all buyer receipts go to a collection account. 70% is swept to a separate account used only for land and construction cost, and the balance goes to a transaction account. All three must be in the same scheduled bank, and a change of bank needs prior MahaRERA approval. Earlier projects continue with the single designated separate account.
What are Form 1, Form 2, Form 3, Form 4 and Form 5?
Form 1 is the architect's certificate on progress, Form 2 the engineer's certificate on cost and progress, and Form 3 the CA's certificate on cost incurred and withdrawals. Form 4 is the architect's completion certificate. Form 5 is the annual report on the project's statement of accounts, signed by the promoter's statutory auditor.
What happens if a quarterly progress report is missed?
MahaRERA issues a notice and publishes the default on the project page, and can restrict portal services. For persistent defaulters, registration can be put in abeyance or cancelled, and penalties can be levied under the Act. In April 2026, MahaRERA issued show-cause notices to 8,212 projects for a single missed quarter.
Can a promoter change plans after registration?
Minor changes are allowed within the law. Changes to sanctioned plans, layout or specifications generally need the prior written consent of at least two-thirds of allottees, other than the promoter, under Section 14(2).
What if the project cannot be completed on time?
The promoter can apply for extension of registration under Section 7(3) or, for force majeure, under Section 6. Applications should be filed well before the validity expires.
Do real estate agents need MahaRERA registration?
Yes. Agents must register under Section 9 before facilitating sales in registered projects, renew every five years, and hold a valid Certificate of Competency.
Can you handle Form 3 and Form 5 for our project?
Our practising Chartered Accountants issue Form 3 certificates with UDIN. Where we are the promoter's statutory auditor, we issue Form 5 instead, and Form 3 is issued by another CA, as MahaRERA requires.
Do you work outside Maharashtra?
Our core practice is MahaRERA. For projects in other states, we can support financial compliance and coordinate the local filing.
How are your fees structured?
One-time assignments such as registration and extensions are quoted per scope. QPR filing, Form 3 and Form 5 are charged per filing.
